Terms of Service

Please read these Terms of Service ("Terms") carefully before using the services offered by Nourished Media LLC ("us", "we", or "our"). Your access to and use of our services is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and clients who wish to access or use our services.

1. Services

Nourished Media LLC provides a range of media services, including but not limited to Search Engine Optimization (SEO), Pay-Per-Click (PPC) advertising, Social Media Marketing, Content Marketing, and Web Design. The specific scope of services, deliverables, and timelines for each client will be outlined in a separate Service Agreement or Statement of Work.

2. Client Obligations

To enable us to perform our obligations, the client shall cooperate with us and provide any information, access to accounts (e.g., Google Analytics, social media profiles), and feedback in a timely manner as reasonably required. The client is responsible for the accuracy and legality of all materials and content provided to us for use in the campaigns.

3. Payment Terms

Payment terms will be specified in the individual Service Agreement. Services are typically billed on a monthly retainer basis, payable in advance. All payments are due within the timeframe specified on the invoice. Failure to make timely payments may result in the suspension or termination of services. All fees are non-refundable.

4. Timelines and Deliverables

We will make every effort to adhere to the project timelines outlined in the Service Agreement. However, these timelines are estimates and are not guaranteed. Delays caused by the client's failure to provide necessary information, feedback, or approvals may extend the project timeline. We are not liable for any damages resulting from such delays.

5. Confidentiality

Both parties agree to keep confidential all information concerning the business, affairs, customers, clients, or suppliers of the other party. This obligation shall continue after the termination of the service agreement. We will take all reasonable steps to protect the confidentiality of your data as outlined in our Privacy Policy.

6. Intellectual Property

Upon full payment, the client will own the rights to the final deliverables created specifically for them (e.g., custom ad copy, blog posts, website design). However, Nourished Media LLC retains the right to use the work for portfolio and marketing purposes. We also retain ownership of all pre-existing materials, tools, software, and proprietary strategies used in the provision of our services.

7. Limitation of Liability

While we strive to provide the best possible results, Nourished Media LLC does not guarantee specific outcomes, such as first-page search engine rankings, specific levels of traffic, or conversion rates. The media landscape is constantly changing, and results are subject to factors beyond our direct control. In no event shall Nourished Media LLC be liable for any lost profits, or any indirect, special, incidental, or consequential damages arising out of or in connection with our services.

8. Termination

Either party may terminate the Service Agreement with written notice, typically 30 days, as specified in the agreement. Upon termination, the client is responsible for all fees incurred up to the effective termination date. We will assist in the orderly transition of any campaign assets or data under our management.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.
